Privacy Policy

Definitions

  1. Administrator – Opinia24 Sp. z o.o., headquartered in Radom at Okulickiego 39, 26-600 Radom, registered in the Register of Entrepreneurs of the National Court Register, maintained by the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register, under KRS number 0000599163, NIP 5213720784, REGON 363645572;
  2. Personal Data – means information about an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier or one or more specific factors defining the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;
  3. EEA – European Economic Area;
  4. Policy – this Privacy Policy;

  5. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation);

  6. Service – the website operated by the Administrator to which this Policy applies, i.e., https://opinia24.pl/;

  7. Act – the Act of 10 May 2018 on the protection of personal data;

  8. User – a person using the services made available on the Service.

Purposes, Legal Bases, and Duration of Data Processing in the Service

  1. Contact Form. The Administrator provides the ability to contact them using the contact form available on the website at https://opinia24.pl/wyprobuj-nas.

    Within the contact form, the Administrator requests the following personal data: name and surname, email address, phone number, message content. Providing personal data is necessary to process the inquiry. Providing personal data for marketing purposes is voluntary.

    Personal data processed within the contact form is processed for the time necessary to respond. In the case of processing data for marketing purposes, the Administrator processes the data until consent is withdrawn or an effective objection is raised.

    Personal data provided within the contact form is processed for:

    1. the purpose of communication, including the establishment of commercial cooperation. The legal basis for processing is the Administrator’s legitimate interest in ensuring communication and establishing commercial cooperation;
    2. the Administrator’s marketing purposes upon obtaining the appropriate consent.

  1. Employee and Contractor Recruitment Process. The Administrator provides recruitment announcements on the website at https://opinia24.pl/en/careers/.

    Providing data is a condition for participation in the recruitment process, and failure to provide them will prevent application for the specified position.

    The Administrator processes personal data provided by the candidate in the CV and other application documents to the necessary extent. Personal data will be processed until the end of the recruitment process. The period may be extended due to potential claims.

    Personal data provided in the recruitment process will be processed on different legal bases depending on the form of employment:

    1. in the case of recruitment leading to employment under a labor contract, personal data will be processed to fulfill obligations under the law, primarily the Labor Code, with the legal basis being the legal obligation incumbent on the Administrator as a potential employer;
    2. in the case of recruitment leading to employment under a civil law contract, personal data will be processed to conduct the recruitment process, with the legal basis being the undertaking of actions before the possible conclusion of the contract.

Rights of Data Subjects

Users of the Service have the following rights regarding their data, in accordance with the requirements set by the GDPR:

  1. access to their data,
  2. rectification of data,
  3. deletion or restriction of processing,
  4. objection to processing, including objection to processing based on the Administrator’s legitimate interest,
  5. data portability,
  6. lodging a complaint with the supervisory authority. In Poland, this is the President of the Personal Data Protection Office, and their website is available at: https://uodo.gov.pl/

To the extent that the User’s data is processed based on consent, such consent can be withdrawn at any time by contacting the Administrator via email at kontakt@opinia24.pl

Recipients

In connection with the operation of the Service, User’s personal data may be transferred to external entities, in particular, providers responsible for IT system maintenance, accounting service providers, marketing agencies, and other entities cooperating with the Administrator.

Data Transfer Outside the European Economic Area

User’s personal data processed within the Service are processed within the EEA. The Administrator will inform Users in advance about any intention to transfer data outside the EEA based on a detailed Transfer Impact Assessment.

Personal Data Security

The security of personal data means protecting them from all threats to ensure business continuity, minimize risk, and maximize the return on business opportunities. This security is achieved through the application of numerous technical and organizational measures.

Maintaining the security of processed personal data is understood as ensuring confidentiality, integrity, availability, and accountability, where:

  1. confidentiality of information – ensuring that only authorized persons have access to the information,
  2. integrity of information – ensuring the accuracy and completeness of information and its processing methods,
  3. availability of information – ensuring that authorized persons have access to the information and related resources when needed,
  4. accountability of information – ensuring the ability to unequivocally attribute a performed action to a specific entity.

The Administrator continuously undertakes actions to ensure the legality of processing and improve the security of processed personal data in their possession and entrusted to them for processing by other entities under relevant agreements.

Cookies

  1. The website opinia24.pl uses cookies. These are small text files sent by a web server and stored by browser software. When the browser reconnects to the site, the website recognizes the type of device the user is connecting from. Parameters allow only the server that created the cookies to read the information contained therein. Cookies facilitate the use of previously visited websites.

  2. The collected information includes IP address, browser type, language, operating system type, internet service provider, time and date information, location, and information sent to the website via the contact form.

  3. The collected data is used to monitor and check how users use our websites to improve the functioning of the service, ensuring more efficient and problem-free navigation. We monitor user information using the Google Analytics tool, which records user behavior on the site.

I. General Information

  2. The data are protected in accordance with the requirements of common law and are being stored on secure servers.
  3. For the interpretation of terms, a glossary of the Regulations is used, or as described in the Privacy Policy (if it results directly from the description).
  4. For the purposes of better understanding of the Privacy Policy, the term “user” has been replaced with the term “you”, and the term “administrator” with the term “we”. The term ‘RODO’ means The Regulation 2016/679 of The European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
  5. We respect your right to privacy and keep your data safe. For this purpose, we use secure communication encryption protocol (SSL), among others.
  6. The personal information provided on the landing page’s electronic form is treated as confidential and is not visible to unauthorized persons.

II. Data Administrator

  1. Personal data shall be processed:
    • in accordance with the provisions on the protection of personal data,
    • in accordance with the Privacy Policy implemented,
    • to the extent and for the purpose necessary to establish, shape, amend or terminate the Agreement and to properly provide electronically supplied Services,
    • to the extent and for the purpose necessary to fulfill the legitimate interests (legitimate purposes), processing shall be without prejudice to the rights and freedoms of the data subject.
  2. Any data subject (if we are the administrator) shall have the right to access, rectify, delete or restrict processing, the right of objection, the right to lodge a complaint with the supervisory authority.
  3. Contact with the person supervising the processing of personal data in the Provider’s organization is possible by electronic means using the contact form on the website, by entering [iod] in the subject field.
  4. We reserve the right to process your data upon termination of the Agreement or to withdraw consent only to the extent that we are required to pursue any claim before a court or if national or EU or international law obliges us to retain the data.
  5. The Service Provider has the right to share your personal information and other personal information with authorized entities under applicable law (e.g. law enforcement).
  6. The deletion of personal data may result from the withdrawal of consent or the lodging of a legally permissible objection to the processing of personal data.
  7. The Service Provider shall not make personal data available to any other party than those authorized under the applicable law.
  8. We have implemented access control to minimize the impact of possible data security breaches.
  9. We process personal data only by persons authorized by us or by processors with whom we cooperate closely.

  1. The personal data controller processes your personal data on the basis of applicable law, agreements and given consent.
  2. Your personal data shall be processed for the purpose/purposes of:
    • the fulfillment of the legal obligations imposed on Opinia24 Sp. z o.o.,
    • the implementation of a legally justified interest of Opinia24 Sp. z o.o.,
    • execution of contracts concluded with counterparties of Opinia24 Sp. z o.o.,
    • In other cases, your personal information is processed only on the basis of your prior consent to the extent and purpose set out in the consent.
  3. With regard to the processing of data for the purposes referred to in point 3, the recipients of your personal data may be:
    • public authorities and bodies performing public tasks or acting on behalf of public authorities, to the extent and for the purposes which derive from the provisions of the common law,
    • other entities that process personal data for and on behalf of the controller on the basis of the relevant agreements signed with Opinia24 Sp. z o.o.
  4. Your personal data will be retained for the period necessary to achieve the objectives set out in point 3 and thereafter for the period and to the extent required by the common law. Data which are processed on the basis of a legitimate interest will be stored until you object to such processing, while data processed on the basis of your consent until you withdraw it, unless there are legal grounds for further storage.
  5. You are entitled to the following rights related to the processing of your personal data:
    • the right of access to personal data, including the right to obtain a copy of such data;
    • the right to request rectification (correction) of personal data where the data are incorrect or incomplete;
    • the right to request the deletion of personal data if:
      • the data are no longer necessary for the purposes for which they were collected or otherwise processed,
      • the data subject has lodged an objection to the processing of personal data,
      • the data subject has withdrawn their consent to the processing of personal data which is the basis for the processing of the data and has no other legal basis for the processing of the data,
      • personal data are unlawfully processed,
      • personal data must be deleted in order to comply with the legal obligation;
    • the right to request a restriction on the processing of personal data if:
      • the data subject questions the accuracy of the personal data,
      • the processing of data is unlawful and the data subject objects to the deletion of the data, requesting in return the restriction of the data,
      • the data controller no longer needs the data for its purposes, but the data subject needs it to establish, defend or redress,
      • the data subject has lodged an objection to the processing of the data until it is established whether the legitimate grounds on the part of the controller prevail against the grounds for objection;
    • the right to transfer data, i.e. the receipt of personal data in a structured, widely used machine-readable computer format. The administrator reserves this right only where technically possible on his part;
    • the right to object to the processing of data, where the following conditions are cumulative:
      • there will be reasons for your particular situation in the case of processing of data on the basis of a task carried out in the public interest or in the exercise of official authority by the controller,
      • the processing is necessary for the purposes of legitimate interests pursued by the controller or by a third party, except where the interests or fundamental rights and freedoms of the data subject are overriding reasons relating to those interests, where the protection of personal data is required, especially when the data subject is a child.
  6. Where the processing of personal data is carried out on the basis of the consent of a person to the processing of personal data (Article 6(1)(a) of RODO), you have the right to withdraw that consent at any time. Such withdrawal shall not affect the conformity of the processing which has been authorized prior to its withdrawal with the applicable law.
  7. In the event of becoming aware of unlawful processing in Opinia24 Sp. z o.o. of your personal data, you have the right to lodge a complaint with the supervisory body, i.e. the President of the Personal Data Protection Office.
  8. Where the processing of personal data is carried out on the basis of the consent of the data subject, the provision of personal data by your data controller shall be voluntary.
  9. Sharing your personal data is mandatory when the processing of personal data is subject to a law or an agreement between the parties.
  10. Your data may be processed automatically and shall not be profiled.
  11. Your data will not be sent to a third country.
